1. Acceptance of Terms
By accessing or using CreaScale AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by CreaScale AI ("we", "us", "our").
2. Description of Service
CreaScale AI is a SaaS platform that uses artificial intelligence to generate Meta Ads creatives, including:
- AI-powered persona and desire analysis (PDA Framework)
- Automated image generation for ad creatives
- AI-generated ad copy (headlines, descriptions, CTAs)
- Creative verification and quality assurance
3. Account Registration
- You must provide accurate, complete information during registration
- You are responsible for maintaining the security of your account
- You must be at least 18 years old to use the Service
- One account per person — duplicate accounts may be terminated
- You are responsible for all activity under your account
4. Subscription Plans and Billing
4.1 Plans
- Starter — $19/month (250 credits — 60 static ads/month + up to 2 AI Videos/month; no image campaigns)
- Pro — $49/month (400 credits/month — videos + static ads, one wallet + 1-click recharge + video API)
- Scale — $299/month (everything in Pro + image campaigns, 1,050 credits/month)
- Enterprise — $799/month (everything in Scale, 2,780 credits/month, full API)
Annual plans are available at a discount (2 months free).
4.2 Billing
- Payments are processed securely through Stripe
- Subscriptions auto-renew unless cancelled before the renewal date
- Unused runs do not roll over to the next billing period
- Credit packs do not expire and are consumed after monthly runs
4.3 No Refund Policy
All purchases are final. CreaScale AI is a digital service and no monetary refunds are provided for subscription fees, credit packs, or any other purchases.
- By subscribing or purchasing credits, you acknowledge that you are purchasing access to a digital AI service and agree that all sales are final
- If a pipeline run fails due to a system error (not user error), the run credit is automatically refunded to your account balance — but no monetary refund is issued
- You may cancel your subscription at any time to prevent future charges, but no refund will be issued for the current billing period
- For EU/UK customers: the Service begins immediate performance on purchase (pipeline runs and credits delivered within minutes). Under the Consumer Rights Directive (2011/83/EU Art. 16(m)) and UK Consumer Contracts Regulations 2013, the 14-day right of withdrawal does not apply to digital content supplied with the consumer's prior express consent once performance has begun. By completing checkout you acknowledge this and consent to immediate performance. For refunds on unused subscription time or unconsumed credit packs purchased in the last 14 days, contact support@creascale.ai — we review case by case.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Generate content that is illegal, harmful, threatening, abusive, or harassing
- Attempt to reverse-engineer, decompile, or hack the Service
- Use automated scripts or bots to access the Service (except approved APIs)
- Resell or redistribute the Service without authorization
- Upload malicious files, viruses, or harmful code
- Circumvent rate limits, usage quotas, or security measures
- Impersonate another person or entity
6. Intellectual Property
6.1 Your Content
You retain ownership of all content you upload (product images, descriptions, landing page data). You grant us a limited license to process this content solely for the purpose of providing the Service.
6.2 Generated Content
AI-generated creatives (images, ad copies) created through the Service are yours to use commercially. We do not claim ownership of generated outputs. However, similar outputs may be generated for other users due to the nature of AI models.
6.3 Our Platform
The CreaScale AI platform — including its design, code, prompts, pipelines, image-generation integrations, and branding — is our intellectual property and is protected by copyright and other laws. The Persona-Desire-Awareness (PDA) framework itself is an industry methodology popularized by Pilothouse Digital; CreaScale's proprietary work is the automated implementation, prompts, and pipeline around it, not the framework concept.
7. Affiliate Program
- Affiliates earn recurring commissions for referred customers who subscribe
- Commission rates vary by tier: Standard, Silver (5+ conversions), Gold (20+ conversions)
- Commissions are subject to a 15-day validation period
- Minimum payout threshold: $100
- Self-referral is prohibited and will result in forfeiture of commissions
- We reserve the right to modify commission rates with 30 days notice
- Fraudulent referral activity may result in account termination
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. The Service may experience downtime for maintenance, updates, or due to third-party provider issues (AI APIs, hosting, payment processing). We are not liable for losses resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
- We are not responsible for the performance of ads created using our Service
- AI-generated content may contain errors — you are responsible for reviewing all outputs before use
10. Termination
- You may cancel your subscription at any time from your account settings
- We may suspend or terminate your account for violation of these Terms
- Upon termination, your data will be retained for 30 days, then permanently deleted
- Outstanding affiliate commissions will be paid out within 60 days of termination
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
